Welcome to Roomly. These Terms & Conditions ("Terms") are a legal agreement between you and Roomly ("Roomly", "we", "us") and govern your use of the Roomly mobile app and related services (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use Roomly.

1. Who we are

Roomly is operated by {{FULL LEGAL NAME}}, currently a sole trader based in the Netherlands, at {{REGISTERED ADDRESS}} ({{KvK number, once registered}}). Roomly is in the process of being registered as a Dutch private limited company (B.V.), after which the B.V. will operate the Service. Contact: support@roomly-app.nl.

2. What Roomly is

Roomly is a platform that helps students find rooms and roommates. We connect people looking for housing ("seekers") with people offering rooms in a home ("home admins" and their members). Roomly is a matching and communication platform only โ€” we are not a landlord, letting agent, or party to any rental arrangement between users (see Section 7).

3. Eligibility

To use Roomly you must:

  • Be at least 18 years old;

  • Be able to enter into a binding contract; and

  • Provide accurate registration information.

We may require verification (such as a student email) before you can access certain features. Verification helps build trust but is not a guarantee about any user (see Section 6).

4. Your account

You are responsible for your account and for keeping your login secure. You agree to provide accurate, current information and to keep it up to date. You may not create fake profiles, impersonate others, or provide false or misleading information. You are responsible for all activity that happens under your account.

5. Acceptable use

When using Roomly, you agree not to:

  • Provide false, misleading, or fraudulent information, or create fake listings or profiles;

  • Harass, threaten, abuse, discriminate against, or harm other users;

  • Post content that is illegal, hateful, sexually explicit, or infringes others' rights;

  • Use the Service for spam, advertising, or any commercial purpose we haven't authorised;

  • Attempt to access data you're not authorised to access, or interfere with or disrupt the Service;

  • Scrape, harvest, or collect other users' data; or

  • Use the Service in violation of any applicable law.

We may remove content and suspend or terminate accounts that violate these Terms (see Section 9).

6. Listings, verification, and matching

  • Listings are user-generated. Home admins are responsible for the accuracy of their listings. Roomly does not verify or guarantee the accuracy, quality, safety, or legality of any listing.

  • Verification has limits. Student verification confirms a verified student email only. It does not guarantee that any user, room, home, or listing is accurate, safe, or suitable.

  • Matching is not a guarantee. Being matched or connected with another user is not a guarantee of compatibility, safety, availability, or a successful housing outcome. You are responsible for your own decisions, including meeting people safely and independently checking any room, home, or person before entering into any arrangement.

7. Roomly is not a party to rentals

Any rental, sublet, deposit, payment, or housing agreement is solely between the users involved. Roomly is not a party to those arrangements and is not responsible for them, including any payments, deposits, contracts, disputes, damage, or the conduct of any user. We do not process rent payments. You are responsible for complying with applicable tenancy and housing laws.

8. Safety, blocking, and reporting

Your safety matters. You can block users or homes and report behaviour that breaches these Terms through the app. We review reports and may act on them, but we cannot guarantee any particular outcome or response time. Reports and related information may be retained for safety and legal purposes as described in our Privacy Policy. If you feel you are in danger, contact your local emergency services.

9. Suspension and termination

You may stop using Roomly and delete your account at any time in Settings โ†’ Account โ†’ Delete account. Deleting your account removes your data as described in our Privacy Policy.

We may suspend or terminate your account, with or without notice, if you breach these Terms, create risk or legal exposure for us or other users, or misuse the Service. Sections that by their nature should survive termination (including Sections 6, 7, 10, 11, and 14) will continue to apply.

10. Content and intellectual property

  • Your content. You keep ownership of the content you post (such as your profile, photos, and messages). You grant Roomly a non-exclusive, worldwide, royalty-free licence to host, store, display, and use that content solely to operate and provide the Service. You are responsible for having the rights to any content you post.

  • Our content. The Roomly app, brand, design, and software are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service except as permitted by law.

11. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We do not guarantee that the Service will be uninterrupted, error-free, secure, or that it will lead to any housing outcome. Features may change or be discontinued.

To the fullest extent permitted by law, Roomly is not liable for any indirect, incidental, or consequential damages, or for the conduct of any user or the outcome of any arrangement between users.

Nothing in these Terms limits or excludes any rights you have under mandatory Dutch or EU consumer law, or our liability for death, personal injury, fraud, or anything else that cannot legally be limited.

12. Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle your personal data.

13. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we'll update the "Last updated" date and, where appropriate, ask you to review and accept the new version in the app. Your continued use of the Service after an update means you accept the revised Terms.

14. Governing law and disputes

These Terms are governed by the laws of the Netherlands. Disputes will be subject to the competent courts of the Netherlands, unless mandatory consumer law entitles you to bring proceedings in your country of residence or gives you other protections that cannot be overridden. EU consumers may also use the European Commission's Online Dispute Resolution platform.
